1. Acceptance of Terms

By creating an account or using our Services, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

MyPostlet is a social media management platform designed to help users manage multiple social media accounts from a single interface. Our Services include:

• Account Integration: Connect your social media accounts from platforms such as Instagram, Facebook, Twitter, LinkedIn, TikTok, YouTube, and Pinterest.
• Content Creation and Scheduling: Create, upload, and schedule posts tailored to each platform.
• Content Management: Manage your content across various platforms with tools for synchronization and platform-specific editing.
• User Authentication: Secure login and account management, including password reset and email verification, handled by Supabase.
• Payment Processing: Subscription management, including handling of subscriptions, cancellations, upgrades, and billing, processed via Stripe.
• Media Handling: Support for media uploads and management, including file type validation, image optimization, and video processing, potentially using Cloudflare R2 for storage.

3. Account Terms

• Eligibility: You must be at least 13 years old to use our Services. The Services are not intended for children under 13.
• Account Registration: You must provide a valid email address and any other information requested to complete the signup process.
• Account Security: You are responsible for maintaining the confidentiality of your account and password. MyPostlet cannot and will not be liable for any loss or damage arising from your failure to secure your account.
• No Automated Accounts: Accounts registered by bots or other automated methods are not permitted and will be blocked or banned.
• User Conduct: You are responsible for all activities that occur under your account. You agree not to use the Services for any unlawful or prohibited activities.

4. Payment, Refunds, and Subscription Changes

• Free Plan: MyPostlet offers a free plan with limited features and a restricted number of posts. We do not require credit card information for the free plan, and we do not sell your data.
• Paid Subscriptions: Users may upgrade to a paid subscription plan, which may include monthly or annual billing options with discounts for yearly payments.
• Billing Cycle: Upon upgrading to a paid plan, your credit card will be charged immediately, and your billing cycle will commence on the day of the upgrade.
• Downgrades and Cancellations: If you cancel your subscription, you will be downgraded to the free plan immediately. We will send multiple reminders before taking any action on inactive accounts.
• Taxes: All fees are exclusive of taxes. Where required, we will collect taxes on behalf of the taxing authority. You are responsible for any additional taxes or duties.
• Refund Policy: We process refunds in accordance with our Fair Refund Policy. Please refer to it for more details.

5. User Content and Intellectual Property Rights

• Ownership of Content: You retain all rights and ownership of the content you upload or create using our Services. We do not claim any intellectual property rights over your material.
• Compliance with Laws: All content shared via our Services must comply with applicable laws, including U.S. copyright laws.
• License to Operate the Service: By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content solely for the purpose of providing the Services.
• Content Removal: We do not pre-screen content but reserve the right to remove any content that violates these Terms or our Use Restrictions Policy.
• Prohibited Actions: You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission from MyPostlet.

6. Prohibited Uses

You agree not to use the Services for:

• Unlawful Activities: Any illegal purposes or in violation of any applicable laws.
• Harmful Content: Uploading or sharing content that is defamatory, obscene, harassing, or otherwise objectionable.
• Interference: Disrupting or interfering with the security or performance of the Services.
• Unauthorized Access: Attempting to gain unauthorized access to any part of the Services or its related systems.
• Automated Use: Using any automated system, including bots, to access the Services.

7. Cancellation and Termination

• User-Initiated Termination: You may cancel your account at any time by accessing the cancellation link in your Account settings. An email or phone request to cancel your account is not considered official cancellation.
• Data Deletion: Upon cancellation, your content will become inaccessible immediately. Within 30 days, all content will be permanently deleted from active systems and logs. Within 60 days, all content will be removed from our backups. This information cannot be recovered once deleted.
• No Proration: If you cancel before the end of your current billing cycle, your cancellation will take effect immediately, and you will not be charged again. We do not provide prorated refunds for unused time. Refer to our Fair Refund Policy for more information.
• Company-Initiated Termination: We reserve the right to suspend or terminate your account and refuse any current or future use of the Services for any reason at any time, especially in cases of policy violations.
• Abuse and Harassment: Any form of abuse, threats, or harassment towards MyPostlet employees will result in immediate termination of your account.

8. Limitation of Liability

You expressly understand and agree that MyPostlet shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or inability to use the Services.
• Unauthorized access to or alteration of your transmissions or data.
• Statements or conduct of any third party on the Services.
• Any other matter relating to the Services.

Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis.

9. Modifications to the Service and Prices

• Service Changes: We reserve the right to modify or discontinue, temporarily or permanently, any part of the Services with or without notice.
• Price Changes: We may change the pricing for our Services. Existing customers will receive at least 30 days' notice of any price changes via email.

10. Third-Party Services

• YouTube API Services: By using our Services to interact with YouTube, you agree to be bound by the YouTube Terms of Service and Google Privacy Policy.
• Payment Processing: Payments are processed via Stripe. By making payments, you agree to comply with Stripe's Terms of Service and Privacy Policy.
• Other Third-Party Services: Our Services may include integrations with Supabase, Cloudflare, AWS SES, and other third-party providers. Your use of these services is subject to their respective terms and policies.
• Pinterest Services: By using our Services to interact with Pinterest, you agree to be bound by the Pinterest Terms of Service and Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

12. Changes to the Terms

We may update these Terms from time to time. When we make significant changes, we will notify you via email. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide by them.

14. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy and any other legal notices published by MyPostlet, constitute the entire agreement between you and MyPostlet.
• Waiver and Severability: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
• Assignment: You may not assign your rights or delegate your obligations under these Terms without our prior written consent.
• Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.
